Partner Visa (Sub Classes 820 and 801)

The temporary partner visa (subclass 820) allows you to live in Australia if you are the actual spouse or partner of:

• Australian citizen
• Permanent resident in Australia
• Qualified NZ citizen.

In some cases, the visa can be granted if your partner’s relationship is terminated.

Temporary partner visa (sub-category 820) is the first phase towards permanent partner visa (sub-category 801). You must be in Australia when you apply and also when you select this visa.

You can submit one application form for your temporary and permanent visas and one application fee. Your application is processed in two phases, about two years away.
The temporary partner visa (subclass 820) allows you to live in Australia if you are the actual spouse or partner of:

• Stay in Australia until a decision is made on a permanent partner visa
• Work in Australia
• Study in Australia, but with no access to government funding
• Registration in Medicare, Australia Plan of Care and Health Expenses.

You can include dependent children in your application, but not dependents (unless you carry or have a potential marriage visa). Applicants must be dependent in Australia when applying.

If you are later granted a permanent visa, you can:

• Stay in Australia indefinitely
• Work and study in Australia
• Apply for Australian citizenship (if you qualify)
• Care for relatives eligible for permanent residence
• Receiving some social security payments
• Travel to and from Australia for five years from the date of the visa – after that time you will need another visa to enter Australia.

Partner’s (temporary) visa (SUBCLASS 309) and partner visa (CLASS 100)

The (temporary) partner visa (subclass 309) allows you to live in Australia if you are the spouse or actual partner of:

• Australian citizen
• Permanent resident
• Qualified NZ citizen.

Partner visa (temporary) (sub-category 309) is the first stage towards permanent partner visa (sub-category 100).
You can only apply for one of your temporary and permanent visas and pay one application fee. Your application is processed in two phases, about two years away.
Must be outside Australia when applying and also when granting partner visa (temporary) (sub-category 309). You can be in or out of Australia when you grant a partner visa (sub-category 100).

• Enter Australia and stay here until a permanent partner visa is decided
• Work in Australia
• Study in Australia, but with no access to government funding
• Registration in Medicare, Australia Plan of Care and Health Expenses.
